Senator Linturi Issued Conditions On Top Of Attempted Rape Charges

Meru Senator Mithika Linturi was charged with attempted rape on Tuesday, September 14 while being arraigned at the Milimani Law Courts.

Court documents seen by Viral Tea revealed that he was charged with attempting to rape Beryl Akoth Owondo, a 36-year-old woman, in Laikipia County.

The incident was indicated to have taken place at Maiyan Villas Hotel in Nanyuki at 3.00 am on January 30, 2021.

"Intentionally and unlawfully attempted to cause your penis to penetrate the vagina of Beryl Akoth Owondo, an adult aged 36 years, without her consent.

"Indecent act with an adult contrary to section 4 of the Sexual Offenses Act of 2006,” read the charge sheet.

The Meru senator is also accused of committing an indecent act with an adult, contrary to section 11(A) of the Sexual Offenses Act of 2006.

“On 30th January 2021 at around 3 am at Maiyan Villas Hotel, Nanyuki in Laikipia East Sub-County in the Republic of Kenya, Linturi intentionally touched the breast and vagina of the woman without her consent,” the charge sheet read.

Appearing before Senior Principal Magistrate Martha Nzushi, the senator pleaded not guilty to the charges.

He requested to be released on reasonable bail terms, through his lawyer, Mothomi Thiankolu.

The prosecution led by Evelyne Onunga did not object to his release but in exchange for conditional terms on the cash bail.

The condition proposed by the prosecution was that Linturi should not interfere with prosecution witnesses directly or indirectly in the event that he is released.

Linturi was released on a Ksh 200,000 cash bail or an alternative of Ksh 500,000 bond by the Nairobi-based court.

The Meru senator in August had moved to court under a certificate of urgency seeking to stop the police from arresting or charging him with the offenses of attempted rape and indecent act with an adult related to the incident. This was after a complaint was filed by the woman who had gone to the Nanyuki hotel with her husband and friends on January 29, 2021.

The letter added that later that day she retired to their room and left the door open as they had agreed with the husband who was still in the company of his friends.

Linturi allegedly offered to settle the matter out of court amicably by offering Ksh200,000 in cash and another Ksh800,000 in a cheque. Linturi reported a case of extortion to the Directorate of Criminal Investigations (DCI) in Laikipia East and turned the couple into suspects.

“At about 3 am she heard the door unlocked and since the lights were switched off she assumed it was her husband and the person got into her bed and started touching her in a very unusual manner,” read the report.

The case is set for mention on October 26, 2021.
