Exiled lawyer Miguna Miguna has termed the appointment of Susan Nakhumicha as the new Health Cabinet Secretary (CS) by President William Ruto on Tuesday, September 27 as a mistake.

Speaking to Gerald Bitok on The Tackle on Wednesday, September 28, Miguna expressed that Ruto had appointed Nakhumicha to the Health docket, taking over from Mutahi Kagwe who served in former President Uhuru Kenyatta's government, despite having no educational background in the subject.

"I have a problem with the minister of health who I don't think understands health. She has a diploma basically as far as I am concerned in some unrelated field.

"Maybe a distant cousin to medicine. I don't think that is the appropriate person to handle the important docket of Health," he said.

Nakhumicha has a diploma in Health Care Management, which she acquired in 2006 before working at AAR Healthcare in Kisumu. She then enrolled on a Procurement and Management degree course at Jomo Kenyatta University in 2007.

For her post-graduate education, she studied Master of Science in Procurement and Logistics at the same university, graduating in 2014. She also undertook her doctorate studies at Jomo Kenyatta University of Agriculture and Technology (JKUAT), graduating with a PhD in Business Management, Operations Management, Supply Chain Research, Procurement and Logistics.

He also took issue with the appointment of former Central Bank of Kenya governor Njuguna Ndung'u to the National Treasury docket, noting that he had performed horribly during his tenure at the bank regulator.

"He failed when he was the governor. He is not somebody who can turn around the economy. So I have a problem with that.

"But of course, the President must know why he appointed him. It is not my prerogative but I have the freedom to say what I am saying," Miguna said.

He however clarified that it is not a must for Cabinet Secretaries to be appointed to the docket they studied for.

"That is not correct because all you ought to understand is public policy and how you are going to provide in that docket. There are people who cannot understand public policy and we know by just looking at their resumes. The rest of the picks I think are excellent," he said.

Nonetheless, he lauded President Ruto's appointment of former Tharaka Nithi Senator Kithure Kindiki as Interior Cabinet Secretary, former Elgeyo Marakwet Senator Kipchumba Murkomen as Transport CS and Mithika Linturi as Agriculture CS.

He then gave conditions before working with President Ruto while terming his return to Kenya as not an implication that he is in support of Ruto’s government but rather a fulfilment of his rights to be in his home country.

“I draw the line where justice ends and injustice starts. Anybody who violates the rule of law and infringes other people's rights, I will oppose. Whether it is Ruto, whether it is Uhuru Kenyatta or Raila Odinga Miguna will oppose you when you disobey laws, or court orders, you violate people's rights and torture them you act like a monarch

"If Ruto wants to act as a monarch then he should be scared of me. If Ruto wants to be governed by the rule of law and the principles of democracy and governance in a way that is fair then Miguna is his buddy and ally," he added.

He further noted that the government would not be doing him any favours by facilitating his return to the country as he was entitled to be in his country of birth.

Miguna added that he was yet to receive affirmation from the government that the red alerts imposed against him had been lifted, but he will board his flight to Kenya and wait for its reaction.
