The Kibera High Court has denied Sarah Wairimu Cohen, the main suspect in the murder of Dutch businessman Tob Cohen, bail after the prosecution opposed her release. Wairimu will be remanded at Lang'ata Women's Prison until two key witnesses testify.

In a ruling delivered on Tuesday, February 18 by Lady Justice Diana Kavedza, the court ruled that the prosecution proved with sufficient evidence the likelihood of witness intimidation and interference.

Justice Kavedza stated that Wairimu's case is of public interest where a life was lost in the most heinous manner. 

"From the analysis above the likelihood to intimidate or interfere with witnesses has been proven with sufficient evidence. Until the two witnesses have testified, the accused is at liberty to revisit the issue of pay at that time," Judge Kavedza ruled.

She further stated that the court must safeguard the trials integrity' by protecting witnesses and preventing potential interference.

According to the High Court, interference may manifest at various stages including during investigation, throughout the trial, or after the filing of charges, and may involve actions by the accused, witnesses, or other parties.

However, Wairimu countered by arguing that six years have elapsed since the commission of the offence hence diminishing the probability of witness interference, arguments that the court overruled.

The Court declined the accused's application for bail and stated that the accused would remain in custody until after the two key witnesses had testified on camera. The matter will be mentioned on February 26, 2025, for pre-trial directions.

Wairimu was arrested again on Thursday, January 23 after the DPP made overwhelming evidence showing that she murdered Cohen. In particular, the DPP, Renson Ingonga, confirmed receipt of new material that would be instrumental in the murder case. 

"Wairimu’s impending arraignment following her arrest on 23rd January 2025 comes after the DPP received new material in relation to Cohen’s death from the Directorate of Criminal Investigations (DCI)," the DPP stated in part.

Detectives from the Homicide Investigations Bureau immediately arrested Wairimu upon receipt of the DPP’s recommendation and detained her at Kilimani Police Station, awaiting court proceedings on Friday, January 24.

Wairimu was facing murder charges following the death of the 71-year-old whose body was discovered in a septic tank in their compound in the couple’s Kitisuru home. She was immediately arrested and later charged with the murder which she denied and was freed on bond.
