The Magistrate Court at the Jomo Kenyatta International Airport (JKIA) was forced to adjourn its case against Nancy Kigunzu alias Mathe wa Ngara after she collapsed during a bail hearing on Monday, August 28.

A clip taken within the court premises showed Mathe lying on the floor with staff trying to attend to her.

The court had convened for the hearing of her case as well as the determination of her bail application, a case which has now been adjourned to a later date.

Earlier, her legal representatives expressed concerns regarding the whereabouts of the Ksh13.4 million seized by the police during a raid at her residence in Ngara last week.

Mathe, through her lawyers Danstan Omari and Cliff Ombeta formally requested information regarding the current location of the money, arguing that the funds were initially intended for a deposit at the Central Bank of Kenya (CBK).

“The money was recovered from the respondent (Nancy), and the state needs to convey to the respondent the issue of where that money is," Omari stated.

"You gave express orders that the money be deposited at the Central Bank. The money is an exhibit if at all the respondent will be charged.”

The prosecution however assured that the money was kept safely and would be produced in court in due course.

“We have documentation showing the chain of custody. The total amount of money deposited at the Central Bank is Ksh13,474,520,” the prosecution responded.

The Ksh13.4 million was seized by police when police raided Kigunzu's drug den in Ngara. However, the High Court last Friday ordered that the amount seized be deposited into the Assets and Recovery Agency’s (ARA) preservation account at a local bank.

The court on Wednesday, August 23 ruled that Mathe wa Ngara should remain in custody for an additional five days pending police investigations, allowing the prosecution's request to extend her detention to allow police more time to question the accused to enhance the investigations.

Kigunzu had earlier told the court that she suffers from anxiety and sought orders allowing her some time off the police station to access medical treatment.

Thuku thus ruled that she was allowed to access medication when required as it is her right. The Muthaiga OSC was directed to ensure that the businesswoman was escorted to the hospital.

However, she warned Kigunzu against using the hospital excuse to execute any crafty schemes.

In an affidavit filed before the court, the Directorate of Criminal Investigations (DCI) stated that there is more than just marijuana impounded at Kigunzu’s place, adding that they need time to engage experts in testing and sampling edibles believed to be laced with illicit substances.

In addition to the accusations, Kigunzu was accused of evading the police, an accusation that her legal representative contested, merely hours before she was arrested in a sting operation in Nairobi Central Business District (CBD) on Monday night.
