Former Gatundu South Member of Parliament Moses Kuria has become the first individual to file a petition against Raila Odinga at the Supreme Court.

Kuria claimed in his petition that Odinga had used chief agent Saitabao Ole Kanchory and others to conduct violence at the Bomas of Kenya which saw Independent Electoral and Boundaries Commission (IEBC) chair Wafula Chebukati assaulted moments before he announced the presidential results.

The violence at the National Tallying Centre, he noted, had prevented Chebukati from carrying out his mandate and announcing the results that were pending in a number of constituencies.

“Shortly after entry of the Commission’s Chairman two other commissioners and the Chief agent gained access to the podium whereby he threatened and physically assaulted the Chairman and the commissioners in full glare of cameras,” states the vocal politician.

“As a result of the said violence at the National Tallying centre, the Chairperson of IEBC was prevented from performing his mandate in that he was unable to announce results from a number of constituencies."

He further argued that the actions had endangered the lives of foreign diplomats, international and local observers, clergymen and women, the three presidential candidates and their families at the time in Bomas, elected leaders, and IEBC officials among many Kenyans who were allowed access to the centre with accreditation.

The attack on Chebukati by the Azimio politicians had also prevented Chebukati from announcing the results of the remaining 38 polling stations that were verified.

“The interference with the declaration of presidential election results and the attack on the Presidential Returning Officer made it difficult for the announce the results of the 38 polling stations that had been verified,” he added.

Kuria's party, which is affiliated with William Ruto's Kenya Kwanza, further accused Raila of keeping silent on the matter and that he had not distanced himself from the actions of his Chief agent.

He wants Odinga to be held responsible for election offences and malpractices that were committed by his duly hired agents during the vote tallying and announcement process.

Kuria further wants the Supreme Court to throw away his petition challenging the presidential results, which declared Ruto the winner.

Taking to his social media handles, Kuria revealed that not only did the Chief Agent cause violence at Bomas, but he had also brandished a gun.

"Raila Odinga through Chief Agent Kanchory and others caused violence at the Bomas of Kenya Tallying Centre, physically assaulted the National Returning Officer and other commissioners and even drew a gun. He has continued with activities to disrupt the electoral process and subvert the will of the people and the Democratic order.

"He who seeks justice must come with clean hands. Hon Rtd Col Geoffrey Kingangi and I have today filed the Supreme Court Petition E006 of 2022. Raila will be disqualified from the Supreme Court Petition as he is not coming with clean hands," he stated.
