YouTuber Georgina Njenga, the girlfriend to former Machachari TV series actor Tyler Mbaya (Baha), responded after a raunchy video of her was leaked onto the internet, which made her trend for the better part of Thursday, January 5.

The clip seen by Viral Tea was leaked on Telegram and captured her dancing naked while inside a room.

While responding to blogger Edgar Obare who sought clarity on the same, Njenga exposed a man who was studying at Kenyatta University (KU) who seemed not to be happy about her relationship with the actor who is also a content creator.

"It happened when I was 17 with someone I liked. He was a guy in KU university's Ruiru campus. Reasons for leaking I don't know," she said.

She added that the incident happened in 2020 and the man began threatening her immediately after she went public regarding her relationship with Baha, despite her not dating him.

When questioned why the man would be upset about her relationship with Baha, Njenga answered "Because it was a win in my life and he had something against me".

Obare then sought to know whether she reported the matter to the authorities and raise it with Baha, to which she responded by confirming that he was aware.

"I don't think he wanted money but once in the threat he asked for $200 (Ksh24,710) but according to how I saw it he just wanted to see me not okay," she went on.

In response, Baha reassured his love for her by sharing on his IG stories a photo of her that she uploaded three weeks ago and black and red heart emojis.

The leaked video caused an uproar on social media with Njenga's fans urging her to take additional action.

"I hope Georgina (Baha's girlfriend) sues the person who leaked the nudes for revenge porn," Gachambi Nderitu wrote.

"On this Georgina Njenga na Baha topic, Edgar Obare needs to be stopped, he needs to be put down," Ouma Sarah weighed in.

In October 2022, Njenga was forced to clear the air on why she uploaded a post on social media indicating she’d broken up with Baha, a post she later pulled down.

“Gosh waking up to many texts and missed calls, we were just playing a truth and dare game with my friends, no wonder it did not even last in my story for 10 minutes.”

Oxford dictionary defines revenge porn as posting revealing or sexually explicit images or videos of a person on the Internet, typically by a former sexual partner, without the consent of the subject and in order to cause them distress or embarrassment.

While there are no specific laws set aside to deal with revenge porn in the country, there are several provisions of the law that may be applied, case in focus is the Computer Misuse and Cybercrime Act of 2018.

The Act makes it a punishable offence to post nude images on the Internet without the consent of the owner with an intent to cause emotional distress. The images are sometimes accompanied by personal information about the subject, including their full name, address and links to their social media profiles.

The Act under section 37 which creates the offence provides to wit; "A person who transfers, publishes, or disseminates, including making a digital depiction available for distribution or downloading through a telecommunications network or through any other means of transferring data to a computer, the intimate or obscene image of another person commits an offence and is liable, on conviction to a fine not exceeding two hundred thousand shillings or imprisonment for a term not exceeding two years or both."

The offence applies both online and offline and to images which are shared electronically or in a traditional way including the uploading of images on the internet, sharing by text and e-mail, or showing someone a physical or electronic image.

The victim, in addition, may also sue the aggressor for defamation as well as breach of privacy. Article 33(3) of the Constitution provides that in the exercise of the right to freedom of expression, every person shall respect the rights and reputation of others, revenge porn violates this law.

Article 31 provides that every Kenyan has the right to privacy which includes the right not to have information relating to their family or private affairs unnecessarily required or revealed; or the privacy of their communications infringed, a right also violated by revenge porn.
