Former Nairobi Governor, Mike Sonko was on Wednesday, June 12 handed a reprieve after the Kahawa West Law Courts approved an application by the Director of Public Prosecutions (DPP) to drop terror charges against him and two other accused persons.

Sonko was arraigned at the courts and charged with terror-related charges in 2021 alongside Clifford Ochieng Ouko and Benjamin Onyango Odhiambo.

Kahawa Law Courts principal magistrate Daniel Kiage stated that he had considered the application by the DPP.

"I hereby mark the matter as withdrawn under section 87A of the CPC," he ruled.

The former Nairobi County boss was arraigned in February 2021 alongside the duo over the terrorism charges and accused of knowingly recruiting unknown persons to “commit or participate in the commission of a terrorist act” in contravention of the Prevention of Terrorism Act, 2012.

Sonko was also accused that on January 31, 2021, he was found in possession of military attire for the commission or facilitation of a terrorist act.

His co-accused Ochieng was charged with being in possession of a military combat short of the North Atlantic Treaty Organization (NATO), a Super Sick military Combat Shirt and a pair of military desert camouflage uniforms for the commission or facilitation of a terrorist act. 

The third accused person, Benjamin Odhiambo, was charged with being in possession of a military camouflage jacket for the commission or facilitation of a terrorist act. They all denied the charges levelled against them.

The ex-county boss was released on a Ksh500,000 cash bail, while the other two co-accused were released on a Ksh200,000 cash bail each.

In February this year, Sonko and 16 others were acquitted in a case relating to the alleged misappropriation of funds amounting to Ksh357 million belonging to the Nairobi county government.

Milimani Magistrate Eunice Nyutu released the former county boss and the 16 co-accused, ruling on Wednesday, February 7 that there was no evidence adduced by the prosecution to show that they conspired to embezzle the aforementioned funds.
