The seven teachers from Itumbe DOK Primary School in Kisii who were arrested for forcing pupils to perform mock sex as a form of punishment will be detained at Nyangusu police station for two more days.

Drucella Moraa, 48, Angelicah Masiah, 33, Catherine Mokeira, 38, Wiliam Isoka, 46, Gladys Kwamoka, 50, Evaline Moraa, 47, and Obadiah Nyaribo, 33 were arrested on Wednesday, February 1.

This is after the video which showed the teachers compelling the young boys in school uniform to perform a mock sex exercise while lying on top of each other as teachers laugh out loud in the background caused a public uproar.

While making a ruling of an application to detain the teachers for 14 days, Ogembo Court, Senior Principal Magistrate Paul Bewott said the suspects will be held for two days to allow time for the investigation officer to conclude investigations.

The officer will be able to record witnesses' statements within the two-day period to enable the prosecution to obtain the charges to prosecute the suspects in court.

This comes after the Teachers Service Commission (TSC) suspended the teachers indefinitely pending the conclusion of investigations by police officers.

If they are found guilty, they will be subjected to disciplinary action as announced earlier by Education CS Ezekiel Machogu.

TSC, in a letter dated Thursday, February 2 and addressed to the teachers, pointed out that coercing the pupils to engage in such actions was a breach of Clause 9 (1) of the Code of Conduct and Ethics for Teachers.

In addition, the six pupils who were all in Grade 2 were exposed to trauma, psychological torture and embarrassment.

Through their lawyer, Edward Begi, the teachers however pleaded with the court to have them released to return to class, given that only one teacher was left in school.

"These teachers have a role to play as they are supposed to be in class. Who will be teaching the rest of the students if they are taken in for those days?” the lawyer posed.

He noted in particular that the Junior Secondary School (JSS) students would be affected, given that no one was deployed in the school.

“The school has only remained with one teacher; furthermore, we are under a new curriculum of CBC. Junior Secondary learners reported just the other day, and it was clear that up to now, no new teacher has been posted to oversee the JSS learners.

"It was said that those who were already there should continue teaching them. Who will look after them?” he questioned.

The 29-second video clip showed the four boys imitating a sexual intercourse process, done in pairs where the voices of three teachers (one male and two female) were heard. They were seated outside on plastic chairs with one female teacher covering her legs with green clothing.
