World Rally Championship (WRC) Safari Rally driver Maxine Wahome now risks being charged with the murder of her deceased boyfriend and rally counterpart, Asad Khan.

This is after police revealed that they are investigating her for the alleged murder, having been treated as the main suspect in the case.

The Office of the Director of Public Prosecutions (ODPP) through state counsel James Gachoka, sought a request to the court to grant them 14 days to conclude investigations into the matter.

Gachoka noted that the events surrounding the matter changed after Asad died on December 18, 2022.

"The circumstances in this investigation have changed following the death of Asad last December. Maxine is now being investigated for murder and grievous harm I request the matter to be mentioned in 14 days," Gachoka told Milimani senior principal magistrate Bernard Ochoi.

He added that the investigating officer had not received the DNA results of the case and they needed two weeks to complete investigations. The death of Asad changed the circumstances surrounding the case as they are no longer investigating assault but murder.

Through her lawyers, Wahome requested the court to vacate the orders by the court that had directed her to appear at the police station every Thursday to help with investigations, requests that Ochoi denied.

She further objected to lawyer Cliff Ombetta appearing in court to represent Khan’s family saying it’s too early for him to be in the matter since she has not been charged.

Wahome stated that Ombetta should allow police to conduct investigations after he wanted to make submissions on behalf of victims in the matter. The Magistrate however ruled that the lawyer had only told the court that they are not participating in investigations but only pointing out areas of concern to be investigated.

He, therefore, allowed the victim's lawyer to make his submissions, to which Ombetta revealed that he was instructed by the family to watch brief in court and he concurred that further investigations need to be carried out in the matter.

"We have written to the DPP for the investigating officer to investigate further some areas we feel as a family need to be covered;" Ombetta said.

Ochoi directed the case to be mentioned on Monday, January 30, 2023, for further directions as Wahome continues to report to the investigating officer every Thursday.

Asad, prior to his death, was fighting for his life at the High Dependency Unit (HDU) at the Avenue Hospital in Nairobi following a domestic spat which led to his girlfriend Wahome being arrested.

Adil said his elder brother lost a lot of blood after the brutal assault on Monday, December 12. He had been admitted to Nairobi Hospital before he was transferred to Avenue Hospital.

He added that his brother was injured by Wahome on Jamhuri Day after she allegedly returned home drunk from a dinner party she had attended on the night of Sunday, December 11.

In the event Wahome is charged with murder and convicted, the 26-year-old top female rally driver could face a lengthy jail term, having come from becoming the first woman to win the WRC3 rally in Naivasha in June 2022 to be in the middle of woes that turned her into an overnight enemy on social media.
