DCI Seeks To Compel Matiang'i To Produce CCTV Footage Of Night Raid

The Directorate of Criminal Investigations (DCI) moved to court seeking orders to obtain the CCTV footage of the Karen residence of former Interior Cabinet Secretary (CS) Fred Matiang'i.

The investigative agency filed a petition seeking orders from the court to compel a private security firm contracted to guard Matiang'i's home to produce to the DCI footage recorded between February 8 and February 9 at midday. 

It revealed that preliminary investigations had established that the residence had surveillance cameras which would offer a vivid picture of the events.

Through an application dated February 10, the investigative agency wants the court to direct the management of the security company manning Matiang'i's home to hand over security footage for the period between 6 AM, February 8 and 11 PM, February 9.

“That an order be and is hereby issued compelling the manager of Amsee Security Services Limited (the Respondent), in person or through a nominee, to extract and avail to the Applicant, through No. 235834 C.1 EUNICE NIUE, a police officer and an investigator attached to County DCI Headquarters Nairobi (Applicant), with the footages for the period between 6:00am on 8th February, 2023 and 11:00 on 9th February, 2023 captured by the Closed-Circuit Television (CCTV) installed and or controlled by the Respondent at the residence of lion. Dr Fred Matiang’i the former cabinet secretary of Interior and National Security,” DCI stated.

In the application before the magistrate court in Nairobi, DCI revealed that they are investigating a case of attempted alleged attempted Robbery contrary to section 297 of the Penal Code as publicly claimed, a matter which has necessitated the making of the subject application.

DCI added that in the morning of Thursday, February 9, 2023, news circulated regarding a purported raid at the residential LR No. 12302/9 within Karen Ngong view in Karen by unknown persons who were alleged to be police officers.

It also maintained that officers from the National Police Service (NPS) never sanctioned the raid as claimed by Matiang'i and his lawyers when they alleged that the officers surrounded his home with the view of arresting him.

DCI is thus relying on investigations to unmask those who were involved in the raid.

“That, preliminary established that the said residential Karen Ngong view within Karen is covered by CCTV cameras manned by the respondent and therefore there is need to retrieve the same for evidential purposes," reads court papers.

DCI further wants the manager directed to service its detectives with a certificate of production of electronic evidence of the CCTV footage. The matter will be mentioned on February 22 to confirm that the manager has complied with the directive.

The move comes after the High Court barred police from arresting the former CS and granted him a Ksh200,000 anticipatory bail, which blocks the police from trying to arrest him.

Directorate of Criminal Investigations (DCI) boss, Mohamed Amin had revealed that preliminary investigations indicated that there was a deliberate attempt to spread false information.

"We have managed to interview several witnesses & our preliminary findings have uncovered evidence of a well-coordinated & deliberate attempt to spread false information and incite public fear. Unfortunately, it was spearheaded by a person of the standing of a former Interior CS.

"According to our investigations, activity began building up at Dr Matiangi's home on Wednesday at 8 pm. Initially, He (Matiang'i) informed his guards some of whom have been interviewed by DCI that he was expecting guests who are lawyers and instructed them to grant access upon their arrival... they (lawyers) arrived shortly after and proceeded to a meeting inside the house of Dr Fred Matiang'i. They were later joined by other politicians, led by none other than Raila Odinga," he stated.

In addition, the Media Council of Kenya (MCK) wrote to requesting information around coverage of the alleged raid by police and other law enforcement agencies at Matiang'i's home as widely reported.

In a statement on Saturday, February 11, MCK revealed that it was carrying out its monitoring function on the evening of Wednesday, February 8 when it stumbled upon live coverage of the police raid which immediately grabbed the attention of members of the public.

MCK CEO David Omwoyo thus wrote to media houses including the Royal Media Services (RMS), Nation Media Group (NMG) and Standard Media Group (SMG) among others requesting to be provided with video evidence of the raid as well as the names of reporters and editors sent to Matiang'i's Karen home.
