Isiolo Governor Abdi Guyo has escaped impeachment after the Senate threw out the charges levelled against him by the County Assembly, citing flaws in the procedure.

On Tuesday, the Senate upheld preliminary objections from the governor’s legal team, which argued that the County Assembly did not follow due process.

A majority of Senators agreed with the defence’s position that the Assembly had not convened on June 18 and 26 to deliberate on the impeachment motion, rendering the process invalid.

Senators also pointed out that a court order was in effect at the time, prohibiting the impeachment proceedings from taking place.

During the vote, 31 elected senators representing county delegations backed the motion to uphold the objection, effectively halting the impeachment process. Twelve senators voted against it, with none abstaining.

Senate Speaker Amason Kingi emphasised that the Senate had already made it clear earlier in the day that if the objection—regarding whether the Isiolo County Assembly had lawfully convened on June 18 and 26, 2025—was upheld, the impeachment would be automatically dismissed.

“This motion having been passed, the impeachment proceedings in the matter of the proposed removal from office of the Governor of Isiolo County have forthwith terminated,” Kingi declared.

The Speaker added that the special sittings, initially set to continue until Thursday, July 10, would be terminated immediately, and the Senate would resume its normal schedule on Wednesday, July 9.

Lawmakers stressed that although impeachment is a legitimate constitutional tool for ensuring accountability, it must be carried out in strict accordance with legal procedures.

“Justice must be served to all parties. In this case, we have the Isiolo County Assembly on one side and the governor on the other. The process and procedure must be followed,” Murang’a Senator Joe Nyutu argued.

“It would be the darkest day for any lawyer if court orders are disobeyed. The question of whether a sitting took place on that day has already been addressed. I am not convinced that there was no sitting on June 26, 2025,” Nairobi Senator Edwin Sifuna weighed in.

This development comes after the High Court ruled that the impeachment of Governor Guyo was invalid and had no legal effect.

Justice Heston Mbogo on Friday, June 27 made the ruling, explaining that this decision was based on an earlier conservatory order issued on June 23, which is still active and continues to protect the governor from removal.

16 out of 18 Members of the County Assembly (MCAs) in Isiolo voted in favour of removing the county boss from office.

The impeachment was initiated by Sericho MCA Abubakar Godana, who accused the Governor of failing to deliver on development projects and falling short of county revenue collection targets.
