Jubilee Party Secretary General Jeremiah Kioni has responded after a civil society group petitioned the Supreme Court to cite him in contempt over his claims of Azimio la Umoja leader, Raila Odinga, winning the 2022 elections.

A lobby group known as Uzalendo Institute of Leadership and Democracy had on Friday, March 10 argued that the Jubilee Party leader had acted against the law on a number of occasions.

The group further claimed that Kioni had misrepresented facts and figures of the apex court judgment on September 5, 2022, on who was validly elected as President in the 2022 General Election.

However, Kioni, who was speaking during Azimio's mega rally in Migori County after Raila announced mass action, stood by his claims of Raila being rigged out of the polls.

"There are some people who have taken me to the Supreme Court because of saying that Raila Odinga's votes were stolen. Were they stolen or not?

"Raila's votes across Kenya were 8.1 million. William Ruto and co had 5.9 million votes...together with his Fuliza. 2.2 million votes were stolen from Raila," he addressed.

The group is seeking to have Kioni gagged from making the said false statements, cited, and punished for contempt of the Supreme Court’s Judgment which validated the election of President William Ruto.

Kioni was accused by the group of holding various public gatherings and misrepresenting the outcome of the Presidential election by alleging that President Ruto did not win the polls.

“Despite the court orders of September 5, 2022, declaring the legitimate Presidential victor in the General Elections, the contemnor has been showing charts in publicised rallies, whose effect is to mislead members of the public as to who won the 2022 Presidential elections,” says the group’s lawyer Dennis Sang in the court papers.

The lawyer wants the application to be certified as urgent and interim gag orders issued pending the hearing of the application. The orders are to bar Kioni, his agents, servants, or members of his coalition from commenting on the judgment.

“It is essential for the maintenance of the rule of law and order that the authority and the dignity of this court are upheld at all times by holding the contemnor accountable for his actions,” Sang added, terming Kioni's “utterances and declarations have resulted in publicized public political rallies which threaten the peace of the republic as well as the economic activities of ordinary citizens”.

Additionally, the lawyer wants the court to issue Kioni with a notice to show cause why he should not be committed to civil jail and ordered to pay a sum of monies as a penalty for being in contempt.

Director of the civil society group, Daniel Kamau Chege, in his affidavit, stated that the actions of Kioni “are likely to create unruliness and anarchy in the country”. The application will be mentioned on March 17, 2023.

Kioni on Wednesday, January 18 claimed that Raila won the election with 8.2 million votes against Ruto's 5.9 million, meaning the former prime minister should have beaten his opponent by 2.3 million votes to be elected Kenya's fifth president.

President Ruto was declared the winner with a total vote count of 7,176,141 (50.49 per cent) against Raila with a total of 6,942,930 (48.85 per cent).
