The High Court has allowed an application by the prosecution to detain Kevin Kinyanjui Kang'ethe, the murder suspect who fled police custody, at the Industrial Area Remand Prison after he was brought before the court on Wednesday, February 14 following his re-arrest.

Wearing a distinctive red hoodie, Kang'ethe was escorted to court at 9:30 am, where he awaited his trial before Magistrate Lucas Onyina. Sporting a red-checked shirt and black trousers, he was accompanied by his legal counsel.

Vincent Monda, representing the prosecution, contended that given the audacious escape by the suspect from Muthaiga Police Station on February 7, the State must exercise increased caution and enhance security measures in this specific case.

The argument emphasized that the individual, under a red notice, should be detained at an Industrial Area Prison rather than a police station.

"I urge this court to make an order that Kang'ethe be detained at the Industrial Area Medium remand prison to secure his attendance in court," the prosecutor stated.

According to Interpol, a red notice is a request to law enforcement worldwide to locate and provisionally arrest a person pending extradition, surrender, or similar legal action.

Monda highlighted the condition that, if the request is granted, Kang’ethe would only be allowed access to the lawyers representing him and no other legal representation.

In response to this, Magistrate Onyina allowed the application by the prosecution, as stated by the Office of the Director of Public Prosecutions (ODPP).

"Milimani Chief Magistrate Hon. Lucas Onyina has today allowed an application by the prosecution seeking to have the fugitive Kevin Adam Kinyanjui Kangethe alias Kevin A. Kangethe detained at Industrial Area Remand Prison pending the hearing and determination of an extradition proceeding against him," stated the ODPP.

Kang'ethe had previously escaped from Muthaiga police station while awaiting extradition to the US on a first-degree murder charge. 

Following a meticulous intelligence operation in Ngong Township, Kajiado, he was apprehended under tight security on Tuesday night.

As Viral Tea had reported, Kang'ethe had sought refuge at his cousin's home in Embulbul after learning of his brother's and girlfriend's arrests in Ololua and Westlands, respectively.
