Man Punches Window At Police Station, Threatens To Attack Cops

A man who was arrested at Kayole Junction in Nairobi broke a window and a door wire grill at Kayole Police Station while threatening to assault police officers on Saturday, February 4.

Dennis Muriithi was arraigned at the Makadara Law Courts and pleaded guilty to charges of malicious damage to property and creating a disturbance.

He was charged with malicious damage to property contrary to Section 339 (1) of the Penal Code and was accused of willfully and unlawfully damaging the items belonging to the National Police Service (NPS) worth Ksh10,000.

Muriithi was also charged with creating a disturbance in a manner likely to cause a breach of peace in contravention of Section 95 (1) (b) of the Penal Code when he shouted at the police officers and threatened to assault them.

He was arrested at the junction and taken to the police station at around 8 am where he refused to give in his name and turned rowdy while at the station.

He went on to the extent of punching the glass window protected by a grill along the corridor leading to the station’s cells.

The accused person pleaded guilty to the charges when he appeared before Senior Principal Magistrate Mary Njagi.

He will return to court on Monday, February 6, when the prosecution will present details of its case against him and avail the damaged property as exhibits before he is convicted and sentenced.

Section 339(1) of the Penal Code states as follows: “Any person who willfully and unlawfully destroys or damages any property is guilty of an offence, which, unless otherwise stated, is a misdemeanour, and is liable, if no other punishment is provided, to imprisonment for five years.”

Section 95 of the Penal Code indicates that "Any person who - (a) uses obscene, abusive or insulting language, to his employer or to any person placed in authority over him by his employer, in such a manner as is likely to cause a breach of the peace; is guilty of a misdemeanour and is liable to imprisonment for six months."

Muriithi's case is almost similar to one that occurred along Thika Road where a 26-year-old woman was sentenced to six months in jail or an alternative fine of Ksh20,000 after she was caught by police officers making out with her lover inside a car and allegedly insulted police officers after being caught in the act.

Appearing before the Makadara Law Courts on Thursday, January 24, Tabby Ndung’u was sentenced by Makadara Chief Magistrate Francis Kyambia after she pleaded guilty to charges of creating a disturbance and offensive conduct at the Thika Road Mall (TRM) Drive in Kasarani, Nairobi on January 24, 2023.

Ndung'u went on to allegedly insult police officers and dared them to shoot her after she was caught in the compromising position.

The businesswoman based in Kasarani admitted to creating a disturbance in a manner likely to have resulted in a breach of peace contrary to section 95 (1) (b) of the penal code after repeatedly shouting “shoot me” at two Administration Police Service officers along TRM Drive.
