Oscar Sudi Threatens To Sue Morara Kebaso Over Photo With Kasmuel McOure

Kapseret Member of Parliament (MP) Oscar Sudi on Saturday, December 28, wrote a demand letter to lawyer and activist Morara Kebaso over defamatory remarks on X (formerly Twitter).

In the demand letter shared by his lawyers, Limo and Njoroge Advocates, Sudi accused Morara of maliciously and recklessly defaming the lawmaker, whose reputation he argued was earned through years of public service and business acumen, through a post on X on December 22, 2024.

The post had Morara circulating multiple photographs, one of which captured Sudi in conversation with Kasmuel McOure, accompanied by the following defamatory statement:

"Oh My God. Kasmuel why? Whhhhyyyy? Aren't these the same people who killed GenZs in cold blood and benefited from it. Why? is it money? Si ungeanza any biz we support you? Kasmuel McOure you have hurt Kenyans who believed in you in a way that you will never ever imagine"

The lawyers further stated that the civic educator who has been at the forefront in regards to keeping the government in check, violated the law by defaming Sudi through direct reference and innuendo.

"By referring to "these same people" and juxtaposing Hon. Sudi's image alongside the phrase "killed GenZs in cold blood and benefited from it", you expressly or by innuendo portrayed our client as: A murderer who was complicit in the unlawful killings of Gen Zs.

"A profiteer who exploited tragedies for personal financial gain. A dishonest leader unworthy of public trust or office. A corrupt associate who compromises the moral fabric of those around him," the letter read in part.

Sudi, through his lawyers also found that the use of the plural "these same people" and the visual presentation of "Photos" with other leaders had implied a criminal conspiracy, falsely associating him with unspecified heinous acts.

He also accused Morara of publishing the alleged defamatory remarks “recklessly and without verifying any facts” noting that Kebaso was doing this recognising the impact his post would have on Sudi’s reputation.  

"The inclusion of Hon. Sudi's photographs was deliberate and calculated to link him to the baseless accusations, attract outrage, and incite public hatred. The publication was made falsely and maliciously, with the intention of discrediting our client and inflicting reputational injury," the lawyers added.

"These allegations are false, malicious, and defamatory. They have caused immense damage to Hon. Sudi's reputation as a respected leader, businessman, family man, and devout member of the community. The post has exposed him to public ridicule, contempt, and hatred."

The lawyers deemed Morara's publication as reckless and irresponsible, considering his substantial audience/followers, which total over 284,000 on the X platform, adding that the harm caused to their client's reputation cannot be overstated.

To that effect, the law firm issued three demands on behalf of their client to Kebaso, amongst them a written, unconditional, and unreserved apology. Other demands were an immediate admission of liability and an express undertaking to not publish any defamatory photograph or statements that can be inferred by innuendo referring to Sudi again. 

"TAKE NOTICE that unless we hear from you on the above within three (3) days of receipt of this letter, we have mandatory instructions to institute relevant legal proceedings against you in the protection of our client's interests, without any further reference to you and at all times holding you liable for the costs thereby incurred and attendant consequences arising therefrom," added the letter.

Morara in response laughed off the demand letter, with reports indicating that the law firm would move to file a lawsuit against him after he intimated that he would not comply with the demands.

In what is seemingly a brewing battle between Sudi and Morara, the lawmaker on December 24 slammed the activist cum civic educator for what he termed as misleading the younger generation and purportedly fleecing Kenyans out of their hard-earned cash.

“Morara Kebaso, stop misleading our children the Gen-Zs for your own selfish gains. Creating havoc and panic in the country instead of constructive criticism. We know you've been fleecing  Kenyans and their hard-earned cash in the name of Activism,” Sudi wrote, adding "We see through your charade—you are a mouthpiece for your paymaster and a willing pawn in his divisive agenda. Fake activist!"
