New Life International Church Pastor Ezekiel Odero on Tuesday, May 16 turned to the Communications and Multimedia Appeals Tribunal in his quest to have his TV station World Evangelism TV reinstated by the Communications Authority of Kenya (CA).

In fresh documents filed after the High Court in Mombasa dealt him a fresh blow to get back his TV station, the televangelist wants the tribunal to overturn a decision by Ezra Chiloba the Director General & CEO of the Communications Authority (CA) to temporarily suspend the operations/frequency of World Evangelism TV

“Chiloba erred in law and in fact when he abruptly suspended World Evangelism TV broadcast licence despite having explicitly granted us a 45-day grace period to adhere to the stipulated regulations and rectify any deficiencies within their establishment,” said Pastor Ezekiel through Musyoki Mogaka and Co Advocates.

Odero further accused Chiloba of failing to restore the television’s broadcasting licence despite writing to the authority to show proof that it complied with the rules and norms.

“This unwarranted suspension is a clear manifestation of unfairness, represents a draconian measure, and flagrantly contravenes my entitlement to fair administrative action and a fair hearing,” he added.

In a supporting affidavit, Odero argued that he uses the TV station with good intentions for world peace and to spread the word of God.

He lamented that several allegations were made by CA against the TV station but a reasonable course of action would have afforded him an opportunity to present a robust defence against the allegations.

“One would reasonably deduce that World Evangelism TV station continues to operate unimpeded. However, it is indeed shocking to note that the station has, in fact, been suspended,” he added.

The televangelist further noted that the television station has been run by his ministry to the required standards and dutifully filed the relevant documentation with the CA.

“The authority's decision to abruptly close the TV station, without extending any form of prior notice or granting the right to a fair hearing, stands as a glaring manifestation of discrimination and extreme unfairness,” he went on.

He has also noted that his TV station is exclusively dedicated to propagating the gospel, embodying a mission of promoting goodwill and spiritual guidance. 

Pastor Ezekiel further stated that the contention arises that the station's closure lacks justifiable grounds, as it fails to demonstrate any tangible negative impact upon any concerned parties, therefore the move to reopen the station becomes an imperative measure in light of its inherently benign nature.

He is thus calling upon the tribunal to set aside or vary the decision and letter directing suspension of the broadcasting licence as well as orders directing the reinstatement of the television frequency and or one directing the uninterrupted broadcast of the television channel.

CA had found that the station had violated broadcasting standards requirements and conditions issued to it before it acquired its license and directed for its suspension with immediate effect from Friday, April 28, alongside Times TV, registered under Good News Media Kenya Limited, associated with Pastor Paul Mackenzie.

"World Evangelism TV was found to have aired inappropriate content on exorcism during the watershed period as well as 12 other violations. Similarly, Times TV aired inappropriate content on exorcism and flouted 17 other broadcasting license conditions," CA stated in part at the time.
