The Child Protection Unit of the Directorate of Criminal Investigations (DCI) has arrested two people who were exposed by former Nairobi Governor Mike Sonko on social media showing one of them feeding a three-year-old child whiskey.

The clip shared by the ex-county boss caused an uproar on social media and got the attention of detectives in the DCI's social media team who forwarded the matter to their undercover colleagues specialised in hunting down child offenders.

"The detectives based at the DCI Academy in South B conducted a comprehensive analysis using their state-of-the-art software for tracking online child offenders and unmasked the identity of the suspects. 

"An undercover operation to arrest the suspects was laid and in the wee hours of today morning, Edward Ndirangu Muhuka, 22 and Abdulmajid Hassan Arafat, 19, were picked from their slumber in Thindigua and Pangani estates respectively," stated the DCI in part.

Detectives have since established that the duo had gatecrashed a Christmas party to which their mutual friend had been invited and went on to outstay their welcome, going to the extent of behaving savagely after the level of kindness that had been extended to them.

The little baby’s mother who retired to bed early after taking care of her guests was shocked after being woken up at 2 am by concerned friends, who saw the trending videotape and shared it with her. 

The duo have been arraigned at the Kiambu Law courts where the first accused pleaded guilty and the second accused not guilty to charges of failing to protect a child from drugs and substance abuse contrary to section 24 (1) (a) as read with section 24 (2) of the Children Act No. 29 of 2022. 

The case will be mentioned on January 18, 2023, for the facts to be read to the first accused and a hearing date to be set. Meanwhile, the second accused was given a bond of Ksh200,000 and a surety of a similar amount.

Kenya has laws that criminalise underage drinking, setting the cap at age 18 as the minimum for the consumption of alcohol. 

According to the Alcoholic Drinks Control Act 2010, it is an offence for a person to sell, give, or supply alcoholic drinks to a person under the age of 18. It is also an offence for a person under the age of 18 to purchase, attempt to purchase or consume alcoholic drinks.

Additionally, it is an offence for a person to allow a minor to consume alcohol on their premises, or to allow a minor to be in licensed premises (such as a bar or nightclub) during the hours when alcoholic drinks are sold or consumed.

In addition, the law also prohibits the abuse or neglect of children, including the abuse or neglect of children through the use of drugs or alcohol and criminalises the exposure of a child to drugs or alcohol, or failure to protect a child from drugs or alcohol.
