The Directorate of Criminal Investigations (DCI) is looking into the credibility of the files Azimio la Umoja One Kenya released on Wednesday, January 18 to ascertain claims that the August 2022 general elections were rigged in favour of President William Ruto.

DCI boss Mohamed Amin revealed in a statement dated January 25, 2023, that he is seeking to establish if offences of “forgery” and “falsification of documents” were committed when the files were released.

The dossier had accused the Independent Electoral and Boundaries Commission (IEBC) of manipulating the results in favour of Ruto, with the Azimio coalition claiming that the documents by an IEBC whistle-blower show the true results of the election.

“In the last few days, the directorate has received numerous correspondence and complaints relating to information circulating online which is attributed to the IEBC. Our attention has also been drawn to documents alleged to be official results of the presidential election," the letter to Chief Executive Officer Hussein Marjan read in part.

Amin further instructed Marjan to submit to the agency original copies of election results from all 290 constituencies.

"For the purpose of lawfully processing the complaints referred above in line with our mandate, we hereby request that you furnish us with certified copies of Forms 34B that were used to tally, verify and declare the result of the presidential elections of August 9, 2022," the letter read in part.

Amin revealed to Marjan that the DCI would look into accusations by Azimio leader Raila Odinga that the IEBC had allegedly used a doctored copy of the aggregated Form 34Bs to declare the election in favour of President Ruto.

"Illustratively, they (Azimio) pointed out various alleged irregularities, including glaring inconsistencies in the watermarks featured in the forms labelled as 34B and which are being passed off as documents emanating from IEBC,” Amin wrote.

In the exercise of the DCI's constitutional mandate, the agency will also investigate the team that provided oversight of the elections on forgery claims.

"Pertinently, the Directorate is investigating the validity and authenticity of the documents in question, In addition to whether offences relating to forgery and falsification of documents have been committed under Sections 345 - 348 of the Penal Code," noted the DCI boss.

On January 23, Jubilee party Secretary General Jeremiah Kioni revealed that Raila won with 8,170,355 votes against Ruto's 5,919,973 votes.

IEBC under former chairperson Wafula Chebukati declared President Ruto was declared the winner with a total vote count of 7,176,141 (50.49 per cent) against Raila with a total of 6,942,930 (48.85 per cent). In the Kamukunji rally, Raila declared that he does not recognise Ruto as President and rejected the 2022 election results totally.
