Former Chief Justice Willy Mutunga was on Saturday, July 8 teargassed at the Central Police Station, which was turned into a battleground as he demanded the release of activists arrested during the Saba Saba demonstrations.

Mutunga was in the company of Boniface Mwangi and other activists who demanded the release of over 30 people arrested during the Friday, July 7 rally spearheaded by opposition leader, Raila Odinga.

He shared a clip on Twitter showing teargas smoke engulfing the station as Mutunga and other attorneys he was in the company of scampered for safety after the law enforcers unleashed teargas on them.

One person was reportedly injured during the incident that disrupted normal operations at the police station. Mwangi, a professional photojournalist, had criticised the daring action and accused the OCS Central Police Station, Moses Mutayi, of violating their constitutional right to demonstrate and picket.

"Police have decided to teargas their workplace and beat some of us. President William Ruto and his deputy Rigathi Gachagua continue to undermine the Constitution," Mwangi lamented. 

He earlier criticised the current regime, accusing it of frustrating the efforts of the former CJ and veteran lawyer, John Khaminwa to have the protesters released on bail.

Other activists who accompanied the trio to Central Police Station were Kenya National Commission on Human Rights commissioner Victor Kamau and city lawyer Lempaa Soyinka. 

"These three lawyers camped here to demand the unconditional release of 32 peaceful citizens who were arrested yesterday in the CBD for taking part in the Saba Saba protests," Mwangi added. 

The activist had earlier appealed to the Azimio La Umoja principals to take responsibility following the arrest of the protesters, calling on Raila and Martha Karua to demand the protesters' release.

"Good morning Raila Odinga, Martha Karua, and the Azimio fraternity. 35 of your supporters were arrested yesterday. They are being held at Central Police Station. It’s your duty to get them released. Activists being held here are 32. The HRDs were arrested in the CBD," said Mwangi.

On Friday, July 7, the retired Chief Justice was captured in a supermarket purchasing food and water for the arrested protesters.

Mutunga opined that the police erred in arresting the protestors citing Article 37 of the 2010 Constitution of Kenya which details the right to picket and assemble.

The one-time CJ observed that dictatorship was taking a course in the country, reversing the gains made in terms of democracy and the citizenry's rights and freedom.

They wanted the 35 unconditionally released from detention as there is no proof they committed crimes while exercising their constitutional right.

According to human rights organisations, over 17 protesters were arrested with scores injured.
