Langata Member of Parliament Phelix Odiwuor popularly known as Jalang’o has affirmed that he is still a member of the Orange Democratic Movement (ODM) despite being kicked out by the party's National Executive Committee (NEC).

Jalang'o was among ODM members who were expelled over their association with President William Ruto. Others included Elisha Odhiambo (Gem), Caroli Omondi (Suba South), Gideon Ochanda (Bondo) and Kisumu Senator Tom Ojienda.

Speaking during a radio show on Radio 47, the lawmaker cum entertainer stated that ODM belongs to former Prime Minister, Raila Odinga, and because he is yet to receive official communication from him, he would not leave the party.

He also assured that he would not be ousted from his seat in Parliament, affirming that he would run the course of his current five-year term.

"Who has kicked me out of the party? ODM belongs to Raila Odinga and if I have not received communication from him then it means I'm still in ODM," he said.

“Let me tell you, the Langata Member of Parliament until 2027 will be me, Phelix Odiwuor Jalang'o. Take this to the bank. No changes are happening."

Jalang'o further noted that he was consulting with his lawyers to appeal the expulsion in court, but he was in no hurry whatsoever.

"What normally happens is that when a party expels you, they write to the Speaker who declares the seat vacant and thus people go back to the ballot. This happens if you will not appeal," he explained.  

The first-time MP, however, expressed confidence that he would win a by-elections poll in any party, should the courts side with the ODM party and uphold his ouster.

Jalang'o also questioned the timing of the decision given that it came after Wiper Party Leader Kalonzo Musyoka, a principal of the Azimio la Umoja coalition which ODM is also a part of, made a rare visit to State House.

He also wondered why ODM decided to fine some MPs and let them go with a warning while the party's NEC expelled others.

"Yesterday, Kalonzo was at State House the whole time, others including Manduku, are friends with the president and went to greet him. Honourable Kanchory was there too, just like us.

"If we all made a mistake and our mistake is the same, why were some fined? What big mistake have we made that we are being dismissed while others stay?" he posed.

The ODM party on Wednesday, September 6 took action against MPs who committed to work with the Kenya Kwanza government, with the NEC accusing them of openly associating with and supporting the activities of a rival political party which is a violation of the ODM party constitution.

The NEC meeting also saw four Members of the County Assembly kicked out over gross misconduct. They included Carolyne Opar, Kennedy Ojwang, Peter Obaso and Regina Kizito.

MPs Mark Nyamita (Uriri) and Paul Abuor (Rongo) were demanded to write an apology to the party and pay a Ksh1 million fine after the duo appeared before the Disciplinary Committee in person, offering explanations considered by the committee which saved them from expulsion.

Nairobi Woman Representative Esther Passaris was reprimanded for openly defying the party's position on the punitive Finance Act 2023 by voting in its favour.

"That Esther Passaris, the Woman MP for Nairobi County be reprimanded for her outright defiance of the party position on the punitive Finance Bill 2023 and that she should issue a written apology to the party within seven days," the party resolved.

"On top of this, Passaris should be fined Ksh250,000 which should be paid within 60 days."
