Former Transport Cabinet Secretary Michael Kamau on Tuesday, May 9 had his Ksh33 million graft case withdrawn.

The Directorate of Public Prosecutions (DPP) Noordin Haji had applied for the withdrawal, which was allowed by Magistrate Victor Wakhumile.

The DPP withdrew the graft case under section 87A of the criminal procedure code on the basis of insufficient evidence to sustain the case.

This section allows a public prosecutor to withdraw the prosecution of any person at any time before judgment is delivered.

This now brings to an end a 7-year battle between the former CS and the Judicial system as well as the Ethics and Anti-Corruption Commission (EACC).

The former CS was being accused of abuse of office and failure to comply with procedures and guidelines relating to the management of public funds.

The particulars of the offences indicated that Kamau ignored the design of the Kamukuywa-Kaptama-Kapsokwony-Sirisia Road which had been done by Engiconsult Consulting Engineers Limited at the cost of Ksh33,303,600 and entering into a Memorandum of Understanding under which the resident engineer redesigned the same road.

He was suspended from the cabinet by former President Uhuru Kenyatta in 2015 after he was named alongside other Cabinet Secretaries in the graft list by EACC. Kamau however denied the charges and challenged his prosecution all the way to the Supreme Court.

President William Ruto on December 23, 2022, appointed Kamau to be the Chairperson of the National Health Insurance Fund (NHIF), marking his comeback to the government.

He held the position for three years effective immediately and took over from Lewis Nguyai in the critical institution, whose appointment was revoked after he was picked by Uhuru.

“In exercise of the powers conferred by section 4 (1) (a) of the National Health Insurance Fund Act, I, William Samoei Ruto, President and Commander-in-Chief of the Defence Forces of the Republic of Kenya, appoint Michael Kamau (Eng.) to be the Chairperson of the National Health Insurance Fund, for a period of three years, with effect from the 23rd December 2022," a gazette notice read in part.
