Asad Khan Woke Me Up Violently At His House- Maxine Wahome

Embattled Safari Rally driver, Maxine Wahome, has claimed that her late boyfriend Asad Khan was violent to her on the day of the alleged assault on him, on December 12, 2022.

While pleading not guilty to charges of killing Asad on Wednesday, March 15, Wahome alleged that Asad had injured himself and she was falsely accused of the crime.

She appeared virtually for the court session after lawyer Phillip Murgor, who is representing Wahome's family, withdrew the application seeking a physical court appearance.

The rally star narrated the events that led to her arrest on December 12, stating that she was arrested by the Kilimani Directorate of Criminal Investigations (DCI) due to an incident that occurred at Preston Apartments on Oloitoktok Road, where she resided with Asad.

She alleged that on the day of the incident, Khan woke her up violently and ordered her to leave his house, adding that she was allegedly attacked in the process and forced to seek refuge on the balcony of the apartment.

She claimed that the deceased attempted to break down the door using his feet and injured himself on the balcony door window panes. Khan then rushed himself to the hospital with Wahome being advised by her parents not to leave the house and wait for the police.

Murgor argued that his client had been in custody since March 7 and that a charge sheet was filed but not provided to her.

He further added that his client should be released on bail, as there was no threat to peace, security, or her own safety, either by the family of the deceased or any member of the public, despite the court yet to make a ruling on the bail application.

Wahome also stated that she would attend all court sessions without fail and would not interfere with witnesses who will testify in the murder case.

The 27-year-old, who has been detained at Kilimani Police Station, had on Tuesday, March 14 successfully undergone a mental health assessment at Mathari Hospital to determine whether she was fit to stand trial.

Justice Lilian Mutende had allowed a request by Assistant Director of DPP Gikui Gichuhi to order a mental assessment before her murder charge the following day.

Murgor had revealed that after reviewing all the facts in the case, he did not understand why his client was charged with murder, but added he would not go into the merits or demerits of the case yet.

He also urged the State prosecutors and the police dealing with the case to swiftly forward him all the evidence they have for an expeditious hearing of the case.

“I have been engaged to lead in the defence of Maxine now that a very surprising charge of murder has been proffered against her. I have reviewed the facts that are in the knowledge of the family and all her friends and from where I stand, I can say with absolute confidence that Maxine is innocent,” he stated.

“We have not seen the evidence they will provide but we just want to say that tomorrow when she is taken to court, we expect the State will not oppose bail,” he said.

Though she agreed to the request for the mental assessment, Justice Mutende revoked Wahome's Ksh100,000 cash bail that had been initially granted by Milimani Senior Principal Magistrate Bernard Ochoi and ordered that she remained in the custody of DCI Kilimani until the day of her plea-taking.

The High Court noted that Wahome is now facing a capital offence, whose verdict carries a mandatory death sentence or life imprisonment upon conviction.
