DCI Summons Fred Matiang'i

The Directorate of Criminal Investigations (DCI) has summoned former Interior Cabinet Secretary Fred Matiang'i.

In a letter to the former CS seen by Viral Tea, Senior Superintended Michael Sang invited Matiang'i to provide information that may assist with investigations into the alleged night raid of his Karen residence on Wednesday, February 8. 

"I Detective Micheal K. Sang, CFE, a Senior Superintendent of police attached to the Directorate of Criminal Investigations Headquarters, Serious Crime Unit, is investigating allegations of Publication of False Information contrary to section 23 of the Computer Misuse and Cyber Crimes Act 2018 amongst other offences in regard to alleged invasion and raid of your residence (the former Cabinet Secretary, Ministry of Interior and National Co-ordination, Dr Fred Matiangi) on the 8th 9th day of February 2023 allegedly by a "battalion" and/or "garrison" of police officers.

"I have reasons to believe that you, Dr Fred Matiangi, the former Cabinet Secretary, Ministry of Interior and National Co-ordination, is connected to the offence or has information which can assist me in my investigations," read the letter in part.

Sang compelled Matiang'i to appear at the DCI headquarters along Kiambu Road at Mazingira House on Friday, February 24, 2023, at 09.30 AM without fail. He warned Matiang'i that failure to comply with the requisition constitutes an offence liable to prosecution.

The summons came after the High Court in Nairobi extended orders stopping the police from harassing or arresting him.

The matter was mentioned on Thursday, February 23 before Justice Justus Bwonwong’a who extended the anticipatory bail granted by Justice Kanyi Kimondo on February 9, 2023.

The Independent Policing Oversight Authority (IPOA) also informed the court that it has filed a preliminary objection as well as an application seeking to be removed from the proceedings. Through its lawyer, IPOA said that it doesn't deal with matters of civilians and therefore it was wrongly named in the case as respondents.

On Thursday, February 9, the High Court granted Matiang'i anticipatory bail after he moved to court seeking it, with his lawyers claiming that his rights were violated and his woes worsened after he mocked President William Ruto's administration during his speech at the home of the former Education CS, the late Prof George Magoha.

Through lawyer Danstan Omari, Matiang'i claimed that he was being targeted for unlawful arrest, which put his family in a state of fear.

Furthermore, the lawyers claimed that the former CS was tipped off by some police officers loyal to him of his looming arrest.

"...has received credible information from officers of the Kenya police that they are under express instructions to arbitrarily capture and arrest him with a view of arraigning him in court for ulterior political motives".

"We seek in the interim that justice should reign. In as much as there would probably be something purported to have been done by Matiang'i, let him be given every civil right entitled to every citizen in the country," one of his lawyers stated.

Matiang’i had urged the court to issue a conservatory order restraining the respondents, their servants, agents, junior officers and/ or anybody from effecting and/or anybody from arresting, charging, harassing or otherwise however interfering with him.

The court however stated that the police are at liberty to investigate him on any criminal conduct, but will not arrest him following the anticipatory bail.

According to Kenyan law, the High Court may grant anticipatory bail, that is, bail pending arrest provided the applicant demonstrates that his or her right to liberty is likely to be compromised or breached unlawfully by an organ of the state that is supposed to protect this right.
