EPRA Announces Fuel Prices For August-September

EPRA explained that the prices are inclusive of the 16 per cent Value Added Tax (VAT) in line with the provisions of the Finance Act 2023, the Tax Laws (Amendment) Act 2020, and the revised rates for excise duty adjusted for inflation as per Legal Notice No. 194 of 2020.

The Energy and Petroleum Regulatory Authority (EPRA) has announced the fuel prices for the period between Tuesday, August 15 and Thursday, September 14.

In a press release dated Monday, August 14, EPRA announced that the fuel prices for Super Petrol, Diesel and Kerosene would remain unchanged.

"In order to cushion consumers from the spike in pump prices as a consequence of the increased landed costs, the Government has opted to stabilize pump prices for the August-September 2023 pricing cycle," stated EPRA in part.

From the previous month, Super Petrol, Diesel, and Kerosene will continue to retail at Ksh194.68, Ksh179.67, and Ksh169.48 effective midnight in Nairobi.

EPRA explained that the prices are inclusive of the 16 per cent Value Added Tax (VAT) in line with the provisions of the Finance Act 2023, the Tax Laws (Amendment) Act 2020, and the revised rates for excise duty adjusted for inflation as per Legal Notice No. 194 of 2020.

As a result of EPRA stabilising the fuel prices for the said period, Oil Marketing Companies (OMCS) will be compensated from the Petroleum Development Fund (PDF).

The price for Super Petrol was calculated at Ksh202.01, Diesel at Ksh183.26, and Kerosene at Ksh175.22, there the oil marketers shall be compensated Ksh7.33, Ksh3.59, and Ksh5.74 respectively.

"The purpose of the Petroleum Pricing Regulations is to cap the retail prices of petroleum products which are already in the country so that importation and other prudently incurred costs are recovered while ensuring reasonable prices to consumers.

"EPRA wishes to assure the public of its continued commitment to the observance of fair competition and protection of the interests of both consumers and investors in the energy and petroleum sectors," added the regulatory authority.

Motorists in Mombasa will pay Ksh191.62 for Super Petrol, Ksh176.63 for Diesel, and Ksh166.43 while their counterparts in Nakuru will pay Ksh193.77 for Super Petrol, ksh179.14 for Diesel, and Ksh168.99.

In other major towns such as Eldoret, motorists will pay Ksh194.53 for Super Petrol, Ksh179.89, and Ksh169.75 for Kerosene.

Motorists in Mandera will however pay Ksh208.68 for Super Petrol, Ksh193.67 for Diesel, and Ksh183.49 for Kerosene, making it the first county in Kenya to have the price of petrol crossing the Ksh200 mark.

Residents in Moyale will pay Ksh204.81, Ksh189.80, and Ksh179.60 for Super Petrol, Diesel, and Kerosene respectively. Those in Eldas will be charged Ksh206.54, Ksh191.52, and Ksh181.33 for  Super Petrol, Diesel, and Kerosene respectively.

Other areas paying above Ksh200 for Super Petrol were Wajir (Ksh204.64), Turbi (Ksh203.10), Loyangalani (Ksh203.31), Kalacha (Ksh203.24), Maikona (Ksh202.66), North Horr (Ksh204.15), Hadado (ksh201.84), Bute (Ksh203.36), Merti (Ksh200.42), Modogashe (Ksh202.20), Elwak (Ksh206.19), Tarbaj (Ksh204.46), and Dadaab (Ksh200.65).

Others were Habaswein (Ksh202.05), Sololo (Ksh203.80), Liboi (ksh202.13), Laisamis (Ksh200.10), Kakuma (Ksh200.73), Lokitaung (Ksh202.93), Lokichogio (Ksh202.00), Kibish (Ksh203.19), Nakalale (Ksh201.92) and Marsabit (Ksh203.12).

On Monday, August 7, the Court of Appeal summoned EPRA Director General Daniel Kiptoo for implementing the fuel levy despite the existence of court orders suspending the Finance Act 2023.

The court issued the summon after Busia senator, Okiya Omtatah sued the EPRA boss for contempt by moving to implement the fuel prices after the High Court had suspended the implementation of the Act on Friday, July 30.
