Suba North Member of Parliament Millie Odhiambo on Thursday, April 20 threatened to lead efforts in amending the Computer Misuse and Cybercrime Act of 2018 by introducing life imprisonment to persons responsible for leaking private photos and videos on the internet.

Speaking during a parliamentary debate on sexual harassment, Odhiambo wants the House to come up with tougher laws aiming to punish perpetrators of such acts, especially those targeting national leaders as was the case with Interior Chief Administrative Secretary (CAS) Millicent Omanga.

A tough-talking Odhiambo made reference to Omanga's situation which occurred on Monday, April 17 when a raunchy video of her, which was later determined to be downloaded from a pornography website and doctored to make it look like it was her, was leaked all over social media platforms and turning Omanga into a trend lasting almost three days.

"What I want to say is that in this country, this must stop. This nonsense must stop. The DCI must follow those guys, every time there are so many women who have been followed and every time we were told to just keep quiet, otherwise, we will not get a blanket.

"You are not going to harass women, I don't care whether you are in UDA or ODM, when it is an issue of women, my party becomes a woman because what is done to a woman will be done to me," she fired.

Odhiambo further expressed her wish at supporting the death penalty as an alternative form of punishment for the culprits but affirmed that she was not a believer in the punishment only reserved for heinous crimes such as treason, murder, or robbery with violence.

However, she threatened to lead the charge in convincing her fellow MPs to enhance the penalties in the Computer Misuse Act to act also as a deterrence to future perpetrators.

"What somebody has done in her privacy, why are you bringing it for us here in public? Honestly, I was so offended I could not even stay in this House yesterday. What nonsense is this? We are going to amend our laws and make stricter penalties.

"I don't support the death penalty, but if I did, I would support the death penalty for such people, but since I don't support the death penalty, I think we need to enhance the sentencing to life imprisonment for people like that," she added.

Odhiambo argued that those who shame other people on the internet should think about the collateral damage of their actions.

"At least if you are not bothered about that person (the victim), have mercy on their children," she went on.

Consensual or not, posting of nudity is an offence under the Computer Misuse & Cybercrimes Act, which specifically provides for a jail term of up to two years or a fine of Ksh200,000.

Section 37 of the Act reads: “A person who transfers, publishes, or disseminates, including making a digital depiction available for distribution or downloading through a telecommunications network or through any other means of transferring data to a computer, the intimate or obscene image of another person commits an offence and is liable, on conviction to a fine not exceeding two hundred thousand shillings or imprisonment for a term not exceeding two years, or to both”.

Multiple fact-checkers, including Viral Tea, had ruled out Omanga being featured in the raunchy video, but former Nairobi Governor, Mike Sonko, claimed that Omanga had called him while on official duty and informed him that she had a stomach problem, prompting the former county boss to intervene to resolve the issue.

"We briefly spoke and she told me she had a running and bloated stomach and I advised her to take club soda or salt and hot water then lie on her stomach all night. Here she seems to be following the instructions I gave, innocently lying on her stomach resting after a long day of tree planting and working for this country that she loves so much.

"She even took the extra piece of advice where I told her to make sure she is ‘free’ so that she can pass gas in that position. Even as you can see from the photo the bedsheets are still well spread, clearly showing that no vigorous activity had taken place," he claimed on Monday, April 17 in his statement which he deleted.

Nairobi Women Representative, Esther Passaris on Wednesday, April 19 condemned the leaking of intimate videos and photos of men and women on the Internet without their consent, terming the unauthorized release of private photos as a violation of people's privacy with the intent of humiliating them in front of the public eye.
