Controversial content creator Brian Chira was on Thursday night, July 27 arrested after making defamatory claims against TikTok star, radio host and influencer, Azziad Nasenya.

Chira was picked up by detectives and forced to spend the night in custody. Information regarding his arrest surfaced on Wednesday, July 26 at around 8.30 pm when Eve Mungai posted a video showing Chira being led into a police station with his hands cuffed.

According to Azziad’s lawyer, Gertrude Kibare from Johnson & Partners Advocates, Chira's arrest was prompted by a live video on TikTok whereby he uttered words deemed to be derogatory to the Soundcity Radio host.

The lawyer further revealed that Chira took a step further and leaked her personal phone number to his followers during the live session.

The consequences of disclosing Azziad's private details meant that she received a bombardment of calls and messages, some of whom from individuals who were outright insulting her, causing her unhappiness and torment.

“Sometime last week Chira went live on TikTok at night and the Topic was Azziad he uttered some words which I cannot repeat here but those words are defamatory and he did not stop there he went ahead and gave and gave out her number.

"My client has for the past week been buzzing with a lot of calls and messages some of which are insults and my client was not happy. Since we have the computer misuse and cybercrime act she choose to take legal action,” the lawyer said in part.

Azziad however was armed with knowledge of the Computer Misuse and Cyber Crime Act and pursued the matter legally.

The lawyer further claimed that the investigating officer and the Directorate of Criminal Investigations (DCI) will conduct investigations before proceeding to the next step, which would be charging Chira in a court of law.

“I insulted her online and she reported it to the police, talk to the officer he will explain, all I was asking is for you to assist,” Chira could be heard talking on the phone from police custody.

Chira has the option to request police bail at this stage before going to court to enter a plea. He is widely known for his online rants and is a student at one of the universities in Kenya.

He recently claimed that he was attacked by three men who allegedly stormed into his house around 9 pm, evidencing this through a video he shared on social media showing a swollen face.

Having mastered a unique technic of entertaining his fans, Chira has lately been using his platform to throw shade at popular local celebrities, however, his latest act against Azziad is likely to land him in real trouble.

According to Gertrude, for the specific offence of defaming Azziad and disclosing her private information, Chira could face a hefty fine of up to Ksh10 million, as stipulated in the relevant sections of the Act (sections 14 to 46).

“If you look at the Computer Misuse and Cyber Crime Act, all the way form section 14 to 46, provides offence and penalties. For this particular offense you can pay a fine of up to 10 million.

“At the moment he has his rights for bail. He can apply for police bail or bond and also, he can still apply for all,” she said.
