Outspoken lawyer, Miguna Miguna, has issued an ultimatum to Standard Media Group (SMG) after he instructed his advocates to file a lawsuit against the media house on grounds of defamation.

Miguna, through his lawyer Adrian Kamotho, demanded the Mombasa Road-based media house to pull down articles he argued had tarnished his reputation.

He cited a response article published by SMG's digital media website regarding his cancelled interview with Spice FM and KTN Home which he viewed as a threat to his reputation.

He was also convinced that the articles that mainly centred on his alleged refusal to sign an indemnity form prior to the interview had exposed him to humiliation.

Miguna further warned the media house against publishing articles similar to the one in question, failure to which he would pursue legal action.

“Take notice that unless you comply as aforesaid within the next seven (7) days from the date hereof, we are under firm, unequivocal and strict instructions to take such action as is necessary to secure our client's interests without further reference to you, and at your own peril as to costs and the legal consequences arising therefrom or incidental thereto,” part of the notice read. 

"We hold you personally and absolutely liable for the unmitigated injury you have committed to our client,"

His lawyer also demanded SMG to admit liability and issue a subtle, fitting and satisfactory apology to him within the given timeline.

Miguna was to be interviewed by Spice FM after landing in the country on Thursday, October 20 but was cancelled on the morning that it was to happen.

According to the firebrand lawyer, who shared the rules captured in a form on social media on Monday, October 24, he was required to sign a guest indemnity form before appearing on The Situation Room hosted by Eric Latiff, Charles Muga and Ndu Okoh. 

He highlighted Clause 5 which compelled him to give a blanket indemnity of the company, which he termed as efforts to gag him before the interview began, a form he refused to sign eventually.

"I've appeared on TV and radio for the past 30 years but not once has a media house - including Standard and KTN News asked me to sign a blanket indemnity form. Spice FM has never asked any of its previous guests to sign the ridiculous form they tried to force on me," Miguna blasted.

The Standard later issued a statement through Tom Japanni, the Standard Group General Manager - Radio Products, in response to the cancellation of the interview.

"I think it's very unfortunate he refused to sign. We had spoken earlier on Friday and made it clear that he had to sign the indemnity form.

"It is not that we don't have confidence in his articulation of issues. He accepted and said there was no problem until he came this morning and refused to sign. We were coming with clean hands and expected the same from him," said Japanni as quoted by Standard Digital.

Miguna however denied Japanni's claims and affirmed that he would pursue legal means.

The lawyer has been highly sought after by media houses to open up on his plight in Canada, where he was deported to in 2018.
