A Nairobi court has sentenced a man who caused grievous bodily harm to a woman he was on a date with, by throwing her off the 12th floor of a building, to five years in prison.

Moses Njoroge was found guilty of committing the offence against Eunice Wangari on September 13, 2020, after they allegedly met for a date in Nairobi CBD.

Milimani principal magistrate Esther Kimilu convicted Njoroge after he was found to have thrown off Wangari from the 12th floor to the ninth floor after they met on Facebook.

She however had mercy on him in pronouncing the five-year sentence as the mandatory sentencing was life in prison.

"I note the mandatory sentence is life imprisonment but due to the remorsefulness of the accused and the commitment to change, has persuaded me to jail him to five years in prison," the magistrate ruled on Thursday, December 1.

The court did not however give an option of a fine. The magistrate added that the victim is still undergoing treatment two years since the incident occurred.

She said she had considered the accused person was committed to rehabilitation due to alcoholism and anger issues.

During his conviction, the court had found that there was no justification for Njoroge's actions, with the magistrate noting that he did not show remorse after the act.

"He kept hitting her in the face with his fist, forcing her to put on shoes that the accused would repeatedly remove," noted Magistrate Kimilu, adding that he did nothing to help after throwing her from the 12th floor.

Wangari had told the court that she met Njoroge, her then-alleged boyfriend, on Facebook and thereafter agreed to physically meet him for their first date in the Nairobi CBD on that fateful day. She added that on the day of the incident, she left her parents' home in Karura for Ambank House in Nairobi's CBD, where she met Njoroge at his office.

They would later go out for lunch together before returning to Ambank House, albeit with a drink in hand, which they imbibed on the 12th floor until around 7.30 pm when Wangari informed Njoroge that she needed to return home.

She told the court that the suspect was however enraged that she was leaving, and insisted on spending the night with her.

Njoroge was then said to have thrown her out of a window on the 12th floor during the ensuing argument, with reports indicating that she fell three floors down to the 9th floor.

Wangari would then spend about two months at Kenyatta National Hospital (KNH) receiving specialized care for her pelvic injuries.

Notably, the incident was discussed on the radio by Homeboyz Radio presenters Shaffie Weru, popular Disc-jockey Joseph Munoru alias DJ Joe Mfalme and Neville Musya, though it was their opinions on the matter that triggered a nationwide uproar and led to them being fired from the Radio Africa Group station.
