President William Ruto has nominated Renson Mulele Ingonga as the new Director of Public Prosecutions; (DPP).

In a communication read out by National Assembly Speaker Moses Wetangula to Parliament, the Head of State recognised Ingonga as a qualified legal practitioner who will serve with honour.

Ingonga is poised to succeed Noordin Haji, who was appointed the National Intelligence Service (NIS) Director General.

The Public Service Commission (PSC) on Thursday, June 29 opened applications for Kenyans intending to succeed Haji as the next DPP.

PSC released a notice by Shadrack Mose, the Chairperson of the seven-member DPP selection panel formed to nominate qualified persons for an appointment for the position.

"Pursuant to provisions of Article 157 of the Constitution and section 8(1) -(4) of the Office of the Director of Public Prosecutions Act, 2013, the Selection Panel invites applications from suitably qualified persons to be considered for nomination for appointment to the position of the Director of Public Prosecutions," the notice read in part.

Requirements

For appointment to this position, a candidate must hold a law degree from a recognized university, be an advocate of the High Court of Kenya, or possess an equivalent qualification from a common-law jurisdiction.

He or she must have at least ten (10) years of experience as a Superior Court Judge or professionally qualified Magistrate; or have at least ten (10) years of experience as a distinguished academic or a legal practitioner or such experience in other relevant legal fields.

Furthermore, the candidate must have held the qualifications aforementioned for a period amounting, in the aggregate, to ten (10) years.

He or she must also be of high moral character, integrity and impartiality, meet the requirements of Chapter Six of the Constitution and demonstrate a high degree of professional competence, communication skills, fairness, good temperament, and good judgment in both legal and life experiences and commitment to public and community service.

Terms Of Service

Regarding the terms of service, the Director of Public Prosecutions (DPP) shall hold office for a term of eight (8) years and shall not be eligible for re-appointment.

The salary and benefits entitled to the position of DPP shall be as determined by the Salaries and Remuneration Commission (SRC). According to SRC, a DPP is entitled to a monthly salary of Ksh765,188 which is computed as;

  1. Basic salary - Ksh459,113
  2. House Allowance - Ksh150,000
  3. Market Adjustment - Ksh156,075

Who Is Ingonga?

Ingonga was among 30 candidates who were shortlisted for interviews which took place in Nairobi for more than one week. The selection panel eventually submitted to President Ruto a list of three qualified candidates, out of which he settled on Ingonga.

He is an Assistant Director at the Office of the Director of Public Prosecutions (ODPP). He is currently the Head of the North Eastern Area and the Anti-Corruption and Economic Crimes Unit at the ODPP.

He is a career prosecutor who has been serving at the prosecutions office for nearly 10 years and holds a Bachelor of Laws Degree from the University of Nairobi and a Master of Laws degree in International Criminal Law from the University of Cape Town. He is also a certified mediator and arbitrator.

Ingonga has extensive experience in criminal law, with a particular focus on corruption and economic crimes and is known as a passionate advocate for justice and human rights, committed to ensuring that the law is applied fairly and impartially, regardless of the circumstances. 

Ingonga floored other shortlisted candidates who included former IEBC commissioner Thomas Letangule, Francis Andayi, lawyer Danstan Omari, Taib Ali, Jacinta Nyamosi, Victor Mule and Tabitha Ouya to the nomination spot.

Others included David Ruto, Winston Ngaira, Peter Mailanyi, Lilian Okumu, Jacob Ondari, James Ndegwa, and David Okachi.

Core functions of the DPP:

The DPP makes the decision to charge and determines what charges should be preferred in a criminal case. The DPP performs the following functions;

  1. To institute and undertake criminal proceedings against any person before any court of law other than a court martial in respect of any offences alleged to have been committed by that person;
  2. To take over and continue any criminal proceedings instituted or undertaken by another person or authority;
  3. To discontinue at any stage before judgment is delivered on any criminal proceedings;
  4. To direct investigation and guide the conduct of criminal investigations;
  5. To handle matters relating to international relations including extradition and Mutual Legal Assistance(MLA);
  6. To advise government Ministries, Departments, Agencies and County Governments on matters pertaining to the development and application of criminal law;
  7. To monitor, train, appoint and gazette public prosecutors;
  8. To facilitate victims of crime and witnesses during prosecution;
  9. To contribute and influence policy, procedure and law reform; and to address complaints raised by ODPP clients that is within the office's mandate.
